This edition of our monthly e-newsletter includes the “Risks of Social Media Usage in Pre-Employment Background Checks, Part I”, discussing how the inclusion of social media search results in employment background reports may expose employers to “protected class” liability and potential discrimination claims. We recommend that employers consult with their employment law attorney before implementing a social media search process.
Our legal alert covers the Fair Employment Opportunity Act of 2011 (HR2501), a bill that prohibits employers from discriminating against an individual based on a history of unemployment, as well as the effect of such discrimination on commerce.
